This is an application for bail moved on behalf of the applicant Lalji indicted in case crime No. 477 of 2006 under section 135 Electricity Act 2003, P.S. Kandharapur District Azamgarh .
Heard Shri Sheo Ram Singh , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that father of the applicant is consumer having electricity connection in his name and its sanctioned load is of 5-6 H.P. The learned counsel submitted that there are no public witnesses.
The learned A.G.A. argued that there is recovery of Rs.98,813/- power consumption, electricity connection against the applicant's father. The learned counsel argued that applicant was found committing theft of electric energy for running welding machine and drill machine with 5 H.P. and one H.P. load..
Having taken into consideration the submissions advanced on behalf of the both the parties and without expressing any opinion on the merits of the case, I consider it to be a fit case for bail.
Let the applicant Lalji indicted in case crime No. 477 of 2006 under section 135 Electricity Act 2003, P.S. Kandharapur District Azamgarh , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
