Heard learned Counsel for the applicants and learned A.G.A.
It is submitted by learned counsel for the applicants that the deceased was drunker. The alleged occurrence had taken place in a sudden quarrel. It was not pre-intended. It was alleged that the injuries were caused by using kicks and fists blows by the applicants. The applicants are cousin of the deceased.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case, the applicants are entitled to be released on bail.
Let the applicants Lalla and Naubhar involved in Case Crime No. 567 of 2006, under Section 323, 504, 304 I.P.C., Police Station Mandwar District Bijnor be released on bail on their furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned.
