1. Respondent no. 2 advertised for inviting tender on 15.5.2006 for maintenance work in different zone of Jhansi division under North Central Railway, Jhansi. The petitioner was one of the applicant. His tender was not considered, hence the writ petition.
2. We have heard counsel for the petitioner and Sri Govind Saran for the Respondents.
3. One of the conditions of the tender was that earnest money should be in the form of fixed deposit drawn on any scheduled bank of Reserve Bank of India. The petitioner has given earnest money in form of fixed deposit of Rani Laxmi Bai Urban Cooperative Bank Ltd, Jhansi. It is not a scheduled bank of Reserve Bank of India and as such no fault can be found with the procedure of the tender committee.
4. It is admitted case of the Respondents that in the past other tender committees have accepted the fixed deposits of the same bank. Considering this, in case the tender has not been finalised, the respondents may consider the tender of the petitioner or any other party in case they officer security in the form of fixed deposits of any scheduled bank. With these observations the writ petition is disposed of.
