Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case the F.I.R. has been lodged on 24.11.2005 at 12.45 p.m. in respect of the incident which had occurred on 21.11.2005. The applicant is named in the F.I.R. only on the basis of last seen evidence. There is no other evidence against the applicant and there is no direct eye witness account.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Mnoj involved in Case Crime No. 234 of 2005, under Sections 302, 201/34 I.P.C. , Police Station Bhawanpur District Meerut be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
