Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that according to the F.I.R. the applicant and 3 other co-accused persons discharged the shots, consequently, the deceased received injuries. According to the post mortem examination report the deceased had received only one gunshot wound of entry, but during investigation in the statements of the witnesses it has been specifically alleged that the shots discharged by Surjeet Singh hit the deceased. Co-accused Sundar alias Surendra, whose case is on the same footing with the case of the applicant, has been released on bail by this court on 18.9.2006 in Criminal Misc Bail application No. 19700 of 2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Parmar involved in Case Crime No. 73 of 2006, under Section 302 I.P.C. , Police Station Agota District Bulandshahar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
