Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. His name came into light during investigation. There is no direct eye witness account. Nothing incriminating has been recovered from the possession of the applicant or at his pointing out. It is alleged that the occurrence had taken place in the dark hours of night. The co-accused Laddan alias Mohd. Niyaz whose case was on the same footing has been released on bail by this court on 13.9.2006 in criminal misc. bail application no. 19308 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Parvez Khan involved in case crime no. 206 of 2006 under Sections 302 I.P.C., P.S. Gahmar District Ghazipur be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
