Heard learned counsel for the applicant and the learned A.G.A.and Sri Anil Malik, learned counsel for the complainant.
It is submitted by learned counsel for the applicant that there is cross version of the alleged incident. From both side F.I.R. have been registered. Both sides have received injuries. From the side of the prosecution one person has lost his life and two persons received injuries. From the side of the applicant the applicant himself and one another person received injury. The applicant has received head injury. The injury received by the applicant has not been explained. The prosecution has not come with clean hands.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Pradeep Chauhan alias Fuddu involved in case crime no. 232 of 2006 under Sections 302,323,504,120-B I.P.C., and section 7 Criminal Law Amendment Act P.S. Brahmpuri District Meerut be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
