Heard learned counsel for the appellants and learned A.G.A on the prayer for bail.
Summon the trial court record within three weeks.
The main role of shooting has been assigned to appellant no.4 Amar Singh . So far as the appellant no.4 is concerned ,his prayer for bail shall be considered on the receipt of record.
So for as the appellants no. 1, 2, 3,5 and 6 are concerned , they have been given the role of causing the injuries by lathi, which were simple in nature.
Considering all the facts and circumstances of the case, we are of the view that appellant no. 1 Krishna Pal Singh, appellant no. 2 Kamal Singh, appellant no.3 Nirmal Singh, appellant no. 5 Narendra Singh and appellant no.6 Jai Karan Singh are entitled to be released on bail . Let appellant no. 1 Krishna Pal Singh, appellant no. 2 Kamal Singh, appellant no.3 Nirmal Singh, appellant no. 5 Narendra Singh and appellant no.6 Jai Karan Singh convicted under sections 148, 323/149, 324/149, 302/149 IPC and sentenced thereunder in Sessions Trial no. 255 of 2001 ( State Vs. Krishna Pal Singh & others) be released on bail during the pendency of appeal on their executing a personal bond and furnishing two reliable sureties each in the like amount to the satisfaction of the Chief Judicial Magistrate Kanpur Dehat.
The C.J.M, Kanpur Dehat , shall send photocopies of personal and surety bonds executed and furnished by and on behalf of the accused- appellants to this Court soon thereafter.
Realization of fine shall remain stayed if Rs.2,500/- out of the fine imposed by the trial court is deposited by each of the appellants within one month .
