It is submitted by learned counsel for the applicant that there is no direct eye witness account. The applicant has named in the F.I.R. on the basis of the doubt and suspicion. One blood stained Khurpi has been recovered at the pointing out of the applicant. The recovery has not been supported by any independent witness.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Ram Pal alias Pappu involved in Case Crime No.464 of 2006, under Sections 302 I.P.C. Police Station Meerganj District Barelli be released on bail his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
