Heard learned counsel for the applicants and the learned A.G.A.
It is submitted by learned counsel for the applicants that according to the F.I.R. the applicants and three other c-accused persons caused injury by using lathi, danda, bricks and stone blows. The deceased received six injuries caused by hard and blunt object in which injury no. 6 was the cause of death. It has not been specifically alleged as to who cased injury no.6. The alleged occurrence had taken place in a sudden quarrel. It was not pre-intended.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case the applicants are entitled to be released on bail.
Let the applicants Sachhidanand Tiwari and Dayanad Tiwari involved in case crime no. 28 of 2006 under Sections 147,323,504,506,336,304 I.P.C., P.S. Tarwan District Azamgarh be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
