This is an application for bail moved on behalf of the applicant Sri Ram indicted in case crime No. 21/2005-2006 under sections 52/9, 39, 44, 50, 51 Wild Life (Protection) Act. P.S. Kodia range Nazibabad District Bijnor.
Heard Shri Gaurav Kakkar , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the applicant is not named in the First Information Report nor any recovery has been made from his possession. The learned counsel argued that the applicant's son is the registered owner of the scooter recovered from the spot. The learned counsel urged that the applicant has been falsely implicated in this case. The learned counsel submitted that the witness Ali Warish has not implicated the applicant in the present case.
The learned A.G.A. argued that applicant is involved in a case of Wild Life (protection) Act and managed his escape from the spot.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant's son Dharamveer is involved in the present case and he is in jail. The scooter recovered from the spot belongs to co-accused Dharamveer. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Sri Ram indicted in case crime No. 21/2005-2006 under sections 52/9, 39, 44, 50, 51 Wild Life (Protection) Act. P.S. Kodia range Nazibabad District Bijnor , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
