Heard Sri A. K. Srivastava, learned counsel for the applicants, learned A.G.A. and perused the record.
Learned counsel for the accused applicants has contended that in this matter co accused Islam who was allegedly arrested at the spot has already been directed to be released on bail by another bench of this Hon'ble Court by order dated 17.11.2005. This accused applicant had managed to escape from the place of occurrence.
In the facts and circumstances of the case, accused is entitled to bail.
Let the applicants Likyakat and Murtaza involved in case Crime No. 551 of 2005 under Section 3/5/8 Cow Slaughter Act, District Muzaffarnagar be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned. They shall also give an undertaking that they will not indulge in any such activity in future. If any adverse report is made against them, it shall be open for the Court below to report to this Court so that their bail may be cancelled.
