Petitioners have approached this Court with the grievance that for the purpose of supplying certain goods on rent, have submitted a tender to the tune of Rs.15,00,000/- and the respondent no.5 to the tune of Rs.18,04,127 plus service tax which comes to Rs. 20,00,000/-. The grievance of the petitioners is that for the reasons best known to the authorities concerned, the proposal of respondent no.5 has been accepted. However, the petitioners are ready to do the work in Rs. 15,00,000/-.
We have heard the learned counsel for the petitioners and the learned Standing Counsel.
As the petitioners have already submitted a representation which is contained in Annexure-5 to the writ petition, it will be appropriate that the District Magistrate be directed to consider the claim of the petitioners and pass appropriate order. The present petition is disposed of with a direction to the District Magistrate, Aligarh to consider the representation of the petitioners and pass appropriate orders within a period of seven days from the date of submission of a certified copy of this order before the respondent no.2.
A copy of the order may be issued to the learned counsel for the petitioner by today itself on payment of usual charges.
