Heard learned counsel for the applicants and the learned A.G.A.and Sri Deepak Gaur, learned counsel for the complainant.
It is submitted by learned counsel for the applicants that according to the prospection version the co-accused Kamlesh used axe blow on the head of the deceased. Thereafter, the applicants cause injury by using lathi and danda blows. Thereafter the applicants and other co-accused again caused injury by using axe blows on the head and neck of the deceased. According to the post mortem examination report the deceased has received contusion. There is no injury cause by axe. The injury no.1 is fatal. It has not been specified as to who caused this fatal injury.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case the applicants are entitled to be released on bail.
Let the applicants Jagannath , Akhilesh and Umed involved in case crime no. 28 of 2006 under Sections 302/34 and 323 I.P.C., P.S.Balrai District Etawah be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
