This is an application for bail moved on behalf of the applicant Rajendra alias Chhida indicted in case crime No. 978 of 2006 under sections 324, 379, 511 I.P.C. P.S. Gajroala District J.P Nagar.
Heard Shri V.P. Gupta, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that applicant and co-accused are said to have made an attempt to commit theft of aluminum plates. The learned counsel pointed out that it is not clear as to whose shot hit the complainant. The learned counsel contended that injuries are of simple nature.
The learned A.G.A. argued that applicant is named in the First Information Report. The learned counsel submitted that applicant and co-accused were found making an attempt to commit theft in the factory and while fleeing away they opened fire which hit the complainant.
I have taken into consideration the submissions advanced on behalf of both the parties.
This being a case of an attempt to commit theft, I consider it to be a fit case for bail.
Let the applicant Rajendra alias Chhida indicted in case crime No. 978 of 2006 under sections 324, 379, 511 I.P.C. P.S. Gajroala District J.P Nagar , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
