This is an  application for bail moved on behalf of the applicant Raju   indicted in case crime No. 409  of 2006  under sections 394, 411, 120-B  I.P.C. and 2/3  U.P. Gangsters  and Anti Social Activities (Prevention) Act, 1986  P.S. Kotwali Nagar  District Bulandshahr.

Heard Shri Pankaj Satsangi holding brief of Shri Gaurav Kakkar, learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicant submitted that the name of the applicant came to fore from the confessional statement of  co-accused Santosh alias Bhandari. The learned counsel urged that recovery of looted gold chains was made from the possession of  co-accused Santosh alias Bhandari. The learned counsel submitted that applicant is said to have supplied information about the wealth of the complainant.

The learned A.G.A. argued that applicant had performed painting work at the residence of the complainant and he gave information to the co-accused about his movable assets.

I have taken into consideration the submissions advanced on behalf of both the parties.

The name of the applicant came to fore from the confessional statement of co-accused Santosh alias Bhandari. The recovery of looted gold chains was made from the possession of the co-accused Santosh alias Bhandari. The applicant was not put up for test identification. The case of the applicant is distinguishable from co-accused Santosh alias Bhandari.In view of these facts, I consider it to be a fit case for bail.  

Let the applicant Raju   indicted in case crime No. 409  of 2006  under sections 394, 411, 120-B  I.P.C. and 2/3  U.P. Gangsters  and Anti Social Activities (Prevention) Act, 1986  P.S. Kotwali Nagar  District Bulandshahr , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
