This is an application for bail moved on behalf of the applicant Sukveer Singh indicted in case crime No.73 of 2006 under section 3/7 Essential Commodities Act P.S. Pisawa District Aligarh.
Heard Shri Hemendra Pratap Singh , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the key of the room from which kerosene oil recovered was in possession of co-accused Sarnam Sharma The learned counsel argued that name of the applicant came to light from confessional statement of co-accused Sarnam Sharma. The learned counsel urged that no recovery was made from the possession or at the pointing out of the applicant.
The learned A.G.A. argued that the applicant is a fairprice dealer and he was a tenant of the room from which the recovery of kerosene oil was made.
I have taken into consideration the submissions advanced on behalf of both the parties.
The key of the room from which kerosene oil recovered was in possession of co-accused Sarnam Sharma which was handed over by him to the raiding party.In view of these facts, I consider it to be a fit case for bail.
Let the applicant Sukveer Singh indicted in case crime No.73 of 2006 under section 3/7 Essential Commodities Act P.S. Pisawa District Aligarh , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
