This is an application for bail moved on behalf of the applicant Pushpendra Singh alias Boby involved in case Crime No. 1009 of 2005, under sections 420, 467, 468, 469, 471, 489 (A) (C) (D) I.P.C., Police station Loni, district Ghaziabad.
Heard Sri R.K. Sharma, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that co-accused Rakesh Kumar has been granted bail by an order of this Court dated 26.6.2006 passed in Criminal Misc. Bail Application No. 12242 of 2006 and the case of the applicant is identical. The learned counsel argued that the applicant is said to have been found in possession of fake currency notes of Rs.1000/- denomination. According to the learned counsel mere possession of fake currency notes is punishable under section 489-C I.P.C.
The learned AGA argued that fake currency notes valuing Rs. five lacs were recovered from the possession of the applicant.
I have taken into consideration the submissions advanced on behalf of both the parties.
The case of the applicant is analogous to co-accused Rakesh Kumar who has been granted bail by an order of this Court dated 26.6.2006. The applicant is in jail for the last about ten months. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Pushpendra Singh alias Boby involved in case Crime No. 1009 of 2005, under sections 420, 467, 468, 469, 471, 489-ACD I.P.C., Police station Loni, district Ghaziabad, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
