This is an application for bail moved on behalf of the applicant Mohd. Irshad alias Kala involved in case Crime No. 298 of 2006, under sections 379, 411 I.P.C., Police station Kotwali City, district Saharanpur.
Heard Sri Ashfaq Ahmad Ansari, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that the applicant is a car mechanic and vehicle was given to him by co-accused Aas Mohammad for repair. The learned counsel urged that there is no previous criminal history of the applicant.
The learned AGA contended that recovery of four cars was made at the pointing out of co-accused Aas Mohammad and the applicant was sitting inside the car connected with present offence.
I have taken into consideration the submissions advanced on behalf of both the parties.
The offences are triable by the Magistrate Ist class. There is no previous criminal history of the applicant. The applicant is in jail for the last about two and half months. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Mohd. Irshad alias Kala involved in case Crime No. 298 of 2006, under sections 379, 411 I.P.C., Police station Kotwali City, district Saharanpur, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
