HIGH COURT OF JUDICATURE OF ALLAHABAD

Special Appeal No. 1133 of 2006

Hon'ble Sushil Harkauli J.

Hon'ble Pankaj Mithal, J.

The appellants have remained posted in the district Mau for the past 13 years since 1993.

By the impugned judgment, the learned single Judge has dismissed the writ petition challenging their transfer from Mau to Ballia.

No government servant can be allowed to continue to remain posted in the same district throughout his life. This itself is sufficient for refusing to exercise the discretionary jurisdiction under Article 226 of the Constitution of India.

The appeal is, therefore, dismissed.
