This is an application for bail moved on behalf of the applicant Ashutosh Yadav alias Raju indicted in case crime No. 169 of 2006 under sections 147, 148, 149, 307, 34, 411 I.P.C. section 7 of Criminal Law Amendment Act P.S. Kotwali Sadar District Deoria.
Heard Shri Deep Chand Singh, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the applicant was arrested in a police encounter case in which none of the police personnel sustained injuries. The learned counsel argued that recovery of cash of Rs. 5000/- from personal search of the applicant and joint recovery of motorcycle is said to have been made.
I have taken into consideration the submissions advanced on behalf of both the parties.
This being a case of no injury, I consider it to be a fit case for bail.
Let the applicant Ashutosh Yadav alias Raju indicted in case crime No. 169 of 2006 under sections 147, 148, 149, 307, 34, 411 I.P.C. section 7 of Criminal Law Amendment Act P.S. Kotwali Sadar District Deoria , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
