This is an application for bail moved on behalf of the applicants Ayyaj Ahmad and Jahid indicted in case crime No. 579 of 2006 under section 3 (1) U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 P.S. Didoli District J.P. Nagar.
Heard Shri Atul Sisodia, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicants submitted that in the gang chart two cases each have been shown against the applicants and they are on bail in the said cases.
The learned A.G.A. argued that applicants are involved in commission of theft of electric wire and in case they are enlarged on bail, they will commit other offences of similar nature.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicants having been enlarged on bail in all the cases shown in the gang chart , I consider it to be a fit case for bail.
Let the applicants Ayyaj Ahmad and Jahid indicted in case crime No. 579 of 2006 under section 3 (1) U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986 P.S. Didoli District J.P. Nagar , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned and subject to an undertaking that they will not misuse the liberty of bail by indulging in antisocial activities and commission of other offences.
