With the consent of the parties, we dispose of this appeal by directing that the entire records will be sent to the Assistant Registrar, Firms, Societies And Chits, Lucknow, for deciding the matter after hearing the parties. This order will be complied by the Assistant Registrar, Allahabad, within three days of the date on which certified copy of this order is presented before him by any of the parties and the records will be sent by "Special Messenger" to Lucknow. The Assistant Registrar, Lucknow Region, will hear the parties on 16th October 2006, on which date both the parties, who are represented before us, will appear before the Assistant Registrar, Lucknow Region.

If for some reason, 16th is declared a holiday or the Assistant Registrar is not available or is not in a position to hear the matter on 16th October 2006, he will hear the matter on 17th or 18th or the next reopening day in case of a holiday declared unexpectedly. After concluding the hearing, which will proceed on day to day basis without giving any adjournment to any of the parties, the Assistant Registrar, Lucknow Region, will deliver the judgment within a further period of two weeks after hearing is concluded.

As stated above, this order has been passed with the consent of both the parties. The special appeal is disposed of with the aforesaid directions.
