This is an application for bail moved on behalf of the applicants Megh Singh and Ram Singh involved in case Crime No. 40 of 2006, under section 307 I.P.C., Police station Sahawer, district Etah.

Heard Sri Jai Narain, learned counsel for the applicants, learned AGA and have perused the record.

The learned counsel for the applicants submitted that the applicants are said to have opened fire at the injured. The learned counsel argued that there  is no supplementary medical report and in X-ray of chest no internal damage was found. The learned counsel submitted that according to the injury report injuries are of grievous nature.

The learned AGA submitted that specific role of firing has been assigned to the applicants and injuries are on vital part of the body. The learned counsel urged that there was motive for the commission of the offences.

I have taken into consideration the submissions advanced on behalf of both the parties.

There is no supplementary medical report of the injured. No internal damage was found in the X-ray of chest. The applicants are in jail for the last more than six months. In view of these facts, I consider it to be a fit case for bail.

Let the applicants Megh Singh and Ram Singh involved in case Crime No. 40 of 2006, under section 307 I.P.C., Police station Sahawer, district Etah, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
