Heard Sri Kapil Tyagi, learned counsel for the applicant, learned A.G.A. and perused the record.
Accused is alleged to have been found in possession of stolen motorcycle on 26.5.2004 and at that time he also fired at the Police Party, however, none was injured. According to the complainant motorcycle was stolen on 18.5.2004 and lodged report on 19.5.2004.
Learned counsel for the applicant has contended that applicant has been falsely implicated and no recovery was made from his possession and that he is in jail since 26.5.2004 and there is no criminal history against the accused.
In the facts and circumstances of the case, accused is entitled to bail.
Let the applicant Salim @ Taxi involved in case Crime No. 83 of 2004 under Sections 379, 411 IPC, P.S. Dhaulana, District Ghazipur be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned. He shall also give an undertaking that he will not indulge in any such activity in future. If any adverse report is made against him, it shall be open for the Court below to report to this Court so that his bail may be cancelled.
