Devdutt v. State Of U.P. & Others - CRIMINAL MISC. WRIT PETITION No. 10511 of 2006 RD-AH 17433 (10 October 2006)
Crl. Misc. Application No. 10511 of 2006.
Dhan Singh --------- Applicant.
State of U.P and others ---- Opp. Parties.
Heard learned counsel for the applicant and learned A.G.A.
The present application under Section 482 Cr.P.C. has been moved for quashing of the order of trial court. The learned counsel for the applicant has submitted that this court, by order dated 3.8.2005 directed the concerned court to decide the trial within six months from the date of production of communication of this order. This order was passed on 3.8.2005 which is over fourteen months. The trial court has not cared for this direction and the case is pending for evidence so far. This is highly objectionable and it will amount to ignore the direction of this Court.
It is hereby directed that the case now be concluded within a period of three months and it may be fixed on day today basis and submit the report to this Court at the conclusion of the trial. In case of default on the part of the trial court, the matter shall be dealt with. The report must be submitted to this Court by 30th of January,2007 positively.
With this direction, the application under Section 482 Cr.P.C. is disposed of finally.
