Pursuant to the order dated 27.9.2006, the case is listed today.

S/Sri B.R.Mishra and Ramesh Chandra , learned counsel for the defendants-appellants nos. 2,3,4 and 5 and Sri Sumit Daga , holding brief for Sri M.K. Gupta, learned counsel for the plaintiff-respondent no.1 , are present.

S/ Sri B.R.Mishra and Ramesh Chandra , learned counsel for the defendants-appellants nos. 2,3,4 and 5 pray that this case may be adjourned today, as they are expecting instructions from the defendants-appellants within two weeks.

Learned counsel for the defendants-appellants nos. 2,3,4 and 5 further state that they would be filing their Vakalatnama on behalf of the defendant-appellant no. 6 within two weeks.

Sri Sumit Daga , holding brief for Sri M.K. Gupta, learned counsel for the plaintiff-respondent no.1 opposes the prayer made for adjournment by S/Sri B.R.Mishra and Ramesh Chandra , learned counsel for the defendants-appellants nos. 2,3,4 and 5 .

It is submitted by Sri Sumit Daga that the Second Appeal was filed in the year 1984, and it is yet to be admitted.

It is further submitted by Sri Sumit Daga that the defendants-appellants have obtained Stay Order dated 20.12.1984 passed on Civil Misc. Second Stay Application No. 6538 of 1984 ( dated 20.12.1984), and in view of the repeated adjournments being taken on behalf of the defendants -appellants, the said Stay Order dated 20.12.1984, be vacated.

Having considered the submissions made by the learned counsel for the defendants-appellants nos. 2 to 5 and the learned counsel for the plaintiff-respondent no.1,I am of the opinion that it is in the interest of justice that the adjournment prayed for, be granted, but the said Stay Order dated 20.12.1984, be made time -bound.

Accordingly, the case is adjourned today.

List on 31.10.2006.

The said Stay Order dated 20.12.1984 is modified to the extent that the Stay Order will continue to remain in operation till 8.12.2006 unless this order is vacated or modified earlier.

The case will not be treated as tied -up with me.
