Heard Sri Abhay Saxena, learned counsel for the applicant, learned A.G.A. and perused the record.
According to prosecution case accused is Gangster and the chart as prepared against him shows that he is wanted in two cases.
Learned counsel for the applicant has contended that accused is on bail in all these cases and that he has been falsely implicated in these cases. He has further contended that accused is not likely to commit such crime in future.
In the facts and circumstances of the case, accused is entitled to bail.
Let the applicant Shakil involved in case Crime No. 464 of 2005 under Section 3(1) Gangester Act, P.S. Shahjad Nagar, District Rampur be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned. He shall also give an undertaking that he will not indulge in any criminal activity and will not cause any threat to the complainant/witnesses. If any adverse report is made against him, it shall be open for the Court below to report to this Court so that his bail may be cancelled.
