Appellant Rubesh has prayed for release on bail in criminal appeal No. 3223 of 2006 filed by him against his conviction order dated 2.6.2006 passed by Addl. Sessions Judge, F.T.C. No. 3, Saharanpur in S. T. No. 142 of 2001, 533 of 2001.
Learned counsel for the appellant has contended that co accused Shamshad @ Motu and others have also preferred criminal appeal no. 3351 of 2006 against the impugned judgement. This appeal be connected with above noted appeal.
Learned counsel for the appellant has contended that co-accused have already been directed to be released on bail by order dated 21.6.2006 and those appellants were convicted under Sections 395, 397, 412 IPC whereas present appellant has been convicted only under Section 412 IPC.
In the circumstances, but without prejudice to the merits of the case, appellant be released on bail, during pendency of this appeal, on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned. He shall also deposit the amount of fine as imposed on him and shall also give an undertaking that he will not indulge in any criminal or antisocial activity and shall be of good behaviour and if any report is found against him, it shall be open for the Court below to report to this Court so that his bail may be cancelled.
