The petitioner has come up against the impugned tender notice dated 13.9.2006 (Annexure no.8 to the writ petition) inviting tender for construction of drainage  through private  contractor.

Heard  the learned counsel for the petitioner as well as  the learned Standing Counsel for the  respondents.

Admittedly  an appeal has been filed and  the same is pending, hence, this writ petition is misconceived

The writ petition is dismissed in  limine.

No order as to costs.
