Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that according to the F.I.R. the applicant and 2 other co-accused persons caused injuries by using lathi blows. The same version has been given by the injured also, but one Hari Lal stated that the head injury was caused by the applicant and co-accused Sanjay has been released on bail by this court on 29.8.2006. It is further contended that the statement of the Hari Lal is after thought, because according to the F.I.R. and statement of the injured all the 3 persons caused injuries by using lathi blows.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Akhilesh involved in Case Crime No. 131 of 2006, under Sections 323 and 304 I.P.C. Police Station Deedarganj District Azamgarh be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
