The petitioner aggrieved by an order passed by the Board of Revenue dated 11th September 2006 whereby a revision filed by the petitioner under Section 333 of U.P. Zamindari Abolition & Land Reforms Act against the order of Commissioner dated 2nd April 2005 has been dismissed. The petitioner filed an application before the Assistant Collector for setting aside the decree with regard to plot no.33-Ga/064 situate in the village concerned. Admittedly the petitioner is not a party to the aforesaid suit. The allegation of the petitioner in the circumstances is that he is interested person, therefore, he filed application for recall of the aforesaid order which, as stated above, has bee allowed by the Assistant Collector by the order dated 27th April 2002. Aggrieved thereby the plaintiff filed revision under Section 333 before the Commissioner. It is this revision which has been allowed and the application filed by the petitioner has been dismissed by order dated 27th April 2002.
I have heard learned counsel for the petitioner. Since the petitioner has not been a party nor he filed an application for impleadment, in these circumstances I agree with the view taken by the Commissioner that the application filed by the petitioner has been rightly rejected by the Assistant Collector. I, therefore, do not find any force in this writ petition. It is accordingly dismissed.
