Heard learned Counsel for the applicant and learned A.G.A.

It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R., whereas 3 persons namely Bulbul, Alok and Khurchan Khurchan Yadav are named in the F.I.R. , but during investigation the name of the applicant has been added at the place of accused Bulbul, who was named in the F.I.R. and it is said that the applicant and co-accused Alok caused injuries by using kicks, fists and danda blows. Co-accused Alok has been released on bail by this court on 12.9.2006 in criminal misc bail application no.19124 of 2006. The case of the applicant is on the same footing with the case of the above mentioned co-accused.

After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without  expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.  

Let the applicant  Lal Amrendra Bahadur Pal alias Chhotey involved in Case Crime No. 505 of 2006, under Sections  304, 323, and 504  I.P.C. and Sections 3(2)(5) of the S.C./S.T.(P.A.) Act, Police Station Lalganj     District  Basti  be released on bail on his furnishing a personal bond and two  sureties each of the like amount to the satisfaction of the Court concerned.
