Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case the F.I.R. is delayed by 4 months without any plausible explanation. The applicant and 3 other co-accused persons are named in the F.I.R. It is said that at the pointing out of the applicant and co-accused Raju the dead body of the deceased was recovered, but co-accused Raju has been released on bail by this court on 30.11.2004 in Criminal Misc Bail Application No. 18926 of 2004. The case of the applicant is also on the same footing with the case of the above mentioned co-accused.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Anil Kumar involved in Case Crime No. 314 of 2004, under Sections 302 and 201 I.P.C., Police Station Hathras Kotwali District Hathras be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
