It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During investigation the name of the applicant has been disclosed by the witness Sajid. His statement was recorded after 7 days of the alleged occurrence. According to his statement injuries were caused by co-accused Mahesh. Co-accused Lokesh has been released on bail by this court on 12.10.2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Debu involved in Case Crime No. 89 of 2006, under Sections 147, 148, 149 302, 307 I.P.C., Police Station Rabupura District Gautam Buddh Nagar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
