Heard learned Counsel for the applicantd and learned A.G.A. and Sri P.K. Chauhan learned counsel for the complainant.
It is submitted by learned counsel for the applicantd that even according to the prosecution version the alleged occurrence had taken place in a sudden quarrel in which the applicantd and other co-accused persons caused the injuries by using lathi and danda blows on 20.6.2006. Due to injuries sustained by the deceased, he died on 25.6.2006, thereafter, the F.I.R. has been lodged on 25.6.2006 at 8.20 a.m. There was no motive or intention to commit the alleged offence.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case, the applicants are entitled to be released on bail.
Let the applicant Noor Mohammad, Buddhu Khan, liyas Khan and Raees Khan involved in Case Crime No. 238 of 2006, under Section 304 I.P.C, Police Station Amritpur District Farrukhabad be released on bail on their furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
