Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that according to the prosecution version the deceased has gone in the company of the applicant and other co-accused persons but he did not return to his house, thereafter, search was made and his dead body was recovered from the tube well. There is no direct eye witness account. The only evidence of last seen is against the applicant.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Resham alias Rishipal involved in Case Crime No. 798 of 2005, under Sections 302 and 120-B I.P.C. Police Station Loni District Ghaziabad be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
