HIGH COURT OF JUDICATURE OF ALLAHABAD

Hon. Sunil Ambwani, J.

Learned counsel for the appellant was appointed on Higher Judicial Service.  Notices were sent to the appellant to engage another counsel which is deemed to be served as the summons have not been returned back either served or unserved.

The appeal was filed in defect.  The Stamp Reporter found that the appeal was filed beyond the period of limitation.  The application for condonation of delay is pending.  No one appears to press the delay condonation application and the appeal.

The second appeal is consequently dismissed both on the ground of delay and for want of prosecution.

Dt. 18.10.2006.
