Heard learned Counsel for the applicant and learned A.G.A. and Sri Indra Kumar learned counsel for the complainant.
It is submitted by learned counsel for the applicant that in the present case co-accused Brijesh Singh, Sunil Patel and Ashok Pandey have been released on bail by this court on 28.7.2006, 11.8.2006 and 10.8.2006 in Criminal Misc Bail Applications No. 13427 of 2006, 16561 of 2006 and 16390 of 2006 respectively. The case of the applicant is on the same footing with the case of above mentioned co-accused.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Sushil Kumar Patel involved in Case Crime No. 4 of 2006, under Sections 363, 376, 302 and 201 I.P.C. , Police Station Reoti District Ballia be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
