Devendra Kumar v. State Of U.P. And Others - WRIT - C No. 58520 of 2006 RD-AH 18006 (19 October 2006)
Hon. Dr. B.S. Chauhan, J.
Hon. Dilip Gupta, J.
The father of the petitioner was employed as a Chaukidar in the Nagar Palika Parishad, Etawah and a house was provided to him by the Nagar Palika Parishad, Etawah. The father of the petitioner retired on 31.12.2002. The petitioner, who was also appointed as a Chaukidar in the Nagar Palika Parishad, Etawah, moved an application that the house earlier provided to his father may be allotted to him and as no orders were passed, he has filed this petition with a prayer that an allotment may be made in his favour.
Learned counsel for the petitioner has not been able to place before us any rule which authorises the petitioner to retain the house provided to his father. In such circumstances, it is not possible for us to grant any relief to the petitioner.
The writ petition is, accordingly, dismissed.
