Humayu Mirza v. State Of U.P. Thru' Secretary (Revenue) Sachivalaya & Others - WRIT - C No. 58378 of 2006 RD-AH 18017 (19 October 2006)
Hon'ble Anjani Kumar, J.
Heard learned counsel for the petitioner.
By the impugned order the revisional authority has directed the petitioner to deposit 1/3 of the amount before entertaining the revision as contemplated in the statute. I do not find that the order passed by the revisional authority, in any way, suffers from any error much less an error apparent on the face of record which may warrant interference in exercise of jurisdiction under Article 226 of the Constitution of India. The writ petition, therefore, has no force and is accordingly dismissed.
However, in case the petitioner deposits 1/3 of amount within one month from today, it should be treated within time.
