Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R., but during investigation the statements of the witnesses Samiullah and Babloo were recorded under Section 161 Cr. P. C. by the I.O. in which they stated that they had seen the applicant and other co-accused in running condition. It is further contended that at the pointing out of the applicant one country made pistol has been recovered. The recovery was planted and there is no other evidence against the applicant. Co-accused Liyakat has been released on bail by this court on 19.8.2006 in Criminal Misc Bail Application No. 16865 of 2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Khalil involved in Case Crime No. 303 of 2006, under Section 302 I.P.C, Police Station Khurja Nagar District Bulandshahar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
