Heard learned Counsel for the applicant and learned A.G.A. and Sri R.P. Tiwari learned counsel for the complainant.
It is submitted by learned counsel for the applicant that the applicant no. 1 is the father-in-law and the applicant no. 2 is the mother-in-law of the deceased. They are old persons. There case is distinguishable with the case of the husband of the deceased. The cause of death is strangulation. It is further contended that the applicants are living separately from the husband of the decesed.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case, the applicants are entitled to be released on bail.
Let the applicants Omvir and Smt Taravati involved in Case Crime No. 336 of 2006, under Sections 498-A, 304-B I.P.C. and Sections ¾ Dowry Prohibition Act, Police Station Modi Nagar District Ghaziabad be released on bail on their furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned.
