Heard learned Counsel for the applicant and learned A.G.A. and Sri Rajeev Sisodia learned counsel for the complainant.
It is submitted by learned counsel for the applicant that in the present case the F.I.R. is delayed . It was lodged on 7.7.2006 at 9.30 a.m. in respect of the incident which had occurred on 6.7.2006 at about 10.00 p.m. The only evidence against the applicant is of last seen. It is said that at his pointing out one country made pistol has been recovered and there is no other evidence and there is no direct eye witness account.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Umesh Singh @ Ravi involved in Case Crime No. 710 of 2006, under Section 302 I.P.C, Police Station Mandi Dhanora District J.P. Nagar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
