Heard learned Counsel for the applicants and learned A.G.A.
It is submitted by learned counsel for the applicants that the applicants are not named in the F.I.R. The statement of Smt Sushila Devi the mother of the deceased was recorded on 10.1.2006 in which she stated that she had given the amount of ransom to unknown miscreants who had stated that the shares has to be given to the applicants also. There is no other evidence against the applicants. Co-accused Bhagwan Das has been released on bail by this court on 4.8.2006 in Crl. Misc Bail Application No. 15917 of 2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case, the applicants are entitled to be released on bail.
Let the applicants Jamuna Prasad and Durga Prasad involved in Case Crime No. 3 of 2006, under Sections 364-A and 302 I.P.C. Police Station Bisalpur District Pilibhit be released on bail on their furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned.
