Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. whereas 3 other co-accused persons are named in the F.I.R. During investigation the name of the applicant and some other co-accused persons have been disclosed by the witnesses. According to their statement the injuries were caused by co-accused Kushal, Kanhaiya and Kishan Lal. It is said that the applicant was having a country made pistol and he was present at the place of occurrence at the time of alleged occurrence, but he did not cause any injury to the deceased. Co-accused Kishan Lal has been released on bail by this court on 11.8.2006 in Criminal Misc Bail Application No. 16408 of 2006 and co-accused Bhupendra has been released on bail by this court on 4.9.2006 in Criminal Misc Bail Application No. 17341 of 2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Kuldeep involved in Case Crime No. 84 of 2006, under Sections 147, 148, 149 and302, I.P.C., Police Station Saslempur District Bulandshahar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
