This appeal has been preferred by Gauri Shankar against the judgement and order dated 27.9.2006 passed by Special Judge, SC/ST Act, Hamirpur in S. T. No. 163 of 1996 whereby the appellant has been found guilty and convicted under Section 324 IPC and Section 3(1)(10) SC/ST Act and has been sentenced to undergo rigorous imprisonment up to one year and fine has also been imposed on him.
Heard learned counsel for the parties and perused the impugned judgement.
Learned counsel for the appellant has contended that appellant is on interim bail from the Trial Court and has already deposited the fine as imposed on him.
In the circumstances of the case, but without prejudice to the merits of the case, appellant be released on bail, during pendency of this appeal, on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned. The compensation as directed by the Trial Court shall be paid to the injured out of the fine allegedly deposited by the appellant.
