Shyam Prakash Pandey v. U.O.I. Thru' Secretary Mini. Of Petroleum And Others - WRIT - C No. 59141 of 2006 RD-AH 18265 (28 October 2006)
Hon. Dr. B.S. Chauhan, J.
Hon. Dilip Gupta, J.
This writ petition has been filed for a direction upon the respondents not to provide Dealership of Kisan Seva Kendra Rura, Kanpur Dehat to private respondent No. 5 pursuant to the interview held on 28.9.2006.
Sri Prakash Padia, learned counsel appearing for respondent Nos. 2 to 4, has raised a preliminary objection that not only is this petition premature but relief can also not be granted in view of the fact that the petitioner has not sought the quashing of the recommendations made by the Selection Committee.
We find considerable force in the submission advanced by the learned counsel for respondent Nos. 2 to 4 inasmuch as it has not been stated in the petition that Dealership has been provided to private respondent No.5. This apart, the petitioner has not sought the quashing of the result of the Selection Committee and, therefore, a direction to the respondents not to provide Dealership to private respondent No.5 on the basis of the recommendations made by the Selection Committee, cannot be granted. We, therefore, decline to entertain this petition and, accordingly, dismiss it. It shall, however, be open to the petitioner, in case he is so advised, to challenge the Dealership in favour of respondent No.5 as and when the occasion arises.
