Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. He has not been put up for identification. The name of the applicant has been disclosed by the co-accused after 5 months of the alleged occurrence and no looted property has been recovered from the possession of the applicant and there is no evidence against the applicant. Co-accused Bharat Singh, whose case is on the same footing with the case of the applicant, has been released on bail by this court on 23.8.2006 in Criminal Misc Bail Application No. 17437 of 2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Azad involved in Case Crime No. 244 of 2005, under Sections 396, 201 I.P.C, Police Station Sadabad District Hathras be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
