This is an application for bail moved on behalf of the applicant Amit Anand Chaudhary involved in case Crime No. 1424 of 2006, under sections 419, 420, I.P.C. and sections 7, 8, 9, 13, 14 of Prevention of Corruption Act, Police station Kotwali, district Azamgarh.

Heard Sri Satish Trivedi, learned senior counsel assisted by Sri Uma Nath Pandey, learned counsel for the applicant, learned AGA and have perused the record.

The learned counsel for the applicant submitted that mere possession of currency notes does not make out an offence under the Prevention of Corruption Act. The learned counsel urged that  there is no evidence of  giving and taking of illegal gratification. The learned counsel urged that money recovered belongs to Kamlesh Chaudhary cousin brother of the applicant and Amit Verma a distant relative. The learned counsel pointed out that co-accused Rajesh Krishna has been enlarged on bail by an order of the Special Judge.

The learned AGA submitted that  recovery of  cash of Rs.2,87,000/- was made from the possession  and at the pointing out of the applicant from his house. The learned counsel urged that the amount was to be given for the selection of Kamlesh Chaudhary and Amit Verma.

I have taken into consideration the submissions advanced on behalf of both the parties.

Having taken into consideration the submissions raised on behalf of both the parties and without expressing any opinion on the merits of the case, I consider it to be a fit case for bail.

Let the applicant Amit Anand Chaudhary involved in case Crime No. 1424 of 2006, under sections 419, 420, I.P.C. and sections 7, 8, 9, 13, 14 of Prevention of Corruption Act, Police station Kotwali, district Azamgarh, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned
